PACT Act Cancer Claims Expedited

Veterans suffering from cancer caused by burn pits will have their PACT Act claims expedited, ensuring that those most in need get the care and benefits they so rightfully deserve.

Nearly 125,000 claims have been filed since the PACT Act was signed into law on August 10, 2022, and out of those, 14,000 are for cancer. Burn Pits and Presumptive Conditions

Burn pits were used overseas by the military to dispose of waste such as chemicals, plastics, medical waste, and unused ordinance. The fumes from these burn pits were toxic and created many health problems for the military personnel who were exposed to them.

Under the PACT Act (Promise to Address Comprehensive Toxics) military personnel suffering health problems from burn pits can put in a claim for medical care and benefits.

In an attempt to speed things up, the Veterans Administration (VA) declared 23 health problems as “presumptive” with more than half of those being some form of cancer. You can read more about burn pit presumptive conditions in our comprehensive article.

What Do I do if I think I qualify for a PACT Act Claim?

The VA began processing PACT Act claims on January 1, 2023 and as stated above, those suffering from cancer will be prioritized.

Other factors that can help expedite a claim are:

  • The Veteran is terminally ill
  • The Veteran is 75 years or older
  • The Veteran is experiencing severe financial hardship

But regardless of whether or not you fall under a condition that would expedite your case, if you are suffering from a presumptive condition, it is imperative that you file your claim as soon as possible. Claims that are not prioritized due to the conditions stated above, will be handled in the order they are received.
