It can be challenging to prove your disability insurance claim when you are fighting migraines. If you are fighting a disability insurance company while suffering from migraines, you should be sure to follow these three strategies.
First, go to your doctor on a regular basis and explain how bad your migraines are. If you do not visit your doctor when having a migraine, you should at least call your doctor regarding your condition. This helps to document how much the migraines impact your life and affect your ability to do work. Your insurance company may not believe your migraines are as bad as they really are, and this helps to document their impact and support your case.
Second, be sure to let your friends and family know when you are having a migraine, and describe it to them so they understand your experience. Your friends and family should be very aware of the ways migraines affect your life. This positions them to be able to make a statement or answer questions regarding the severity of your condition.
Third, keep a migraine journal. Migraine Buddy is an app that helps you to record the frequency and severity of your migraines. Insurance companies often do not believe migraines are as frequent or severe as claimants say they are. What you need to prove is that you are not able to work one or two days per week, on average, which is something employers will not tolerate. Weeks and months of well-kept journals can provide the records you need to prove your claim. Watch the video to learn more.
At Tucker Disability Law we handle these cases every day. If your claim has been denied, or if you have any additional questions, call Tucker Disability Law at (866) 282-5260, or review our videos and media library for more information.
Video TranscriptThree strategies for winning your migraine disability insurance claim. My name's John Tucker. And if you're suffering from migraines and fighting a disability insurance company, it can be a challenge. I want to give you three strategies for how you can win your claim. First, one of the most important things you can do if not the most important, go to your doctor on a regular basis. And be sure when you go to the doctor tell them how often you're having migraines. Explain how bad those migraines are. One of the biggest problems people with migraines face when fighting a disability insurance company, is that the disability insurance company just doesn't believe it's as bad as they say. They don't believe the migraines are happening as often as they say. If you go to the doctor or even just call your doctor when you're having migraines, that will help you document your claim.
Second, tell your friends and your family when you're having a migraine. You may think that your spouse or your kids see you when you're having a migraine, but not everyone knows. If you tell all of the people in your life that you're experiencing a migraine, they'll understand that it's happening. But also tell them the symptoms. Tell them how bad it is. Tell them what you're feeling. Describe it in terms that they would understand. That will allow them to write a statement at some point or answer an insurance company's questions about how bad your condition is.
Finally, the most common thing that we recommend our clients is to keep a migraine journal. Use an app like Migraine Buddy. I don't get paid anything for recommending Migraine Buddy. But they actually have a very good platform for recording the symptoms. The severity, the frequency, the problems that go along with a migraine, the things that would help somebody understand not only how many migraines you have, but what they're like and how they impact you.
Remember this, to prove a disability claim you don't have to prove you're in a coma. You don't have to prove that you can't leave your house every day. You really just have to prove that one or two days a week on average, you would not be able to go to work. No employer will tolerate that. Well if you're having migraines that frequently and you have journals going back weeks and months in time that contemporaneously verify that, that means notes you made at that time that verify you're having that many migraines, that will help you prove your claim. Now if your claim has been denied give us a call at the number on your screen. We represent people from Florida to Alaska and all 50 states in these types of cases, and we can help you. I'm John Tucker. Thanks for watching.
