As a Veterans Disability attorney, I’m seeing an alarming rise in VA benefits scams targeting our nation’s Veterans. With VA benefits now totaling $135 billion annually and the PACT Act expanding coverage, fraudsters are devising increasingly sophisticated schemes to steal Veterans’ hard-earned benefits. Let me help you identify and avoid these predatory schemes.
Understanding VA Benefits Scams Today
Claims predators are particularly dangerous because they appear legitimate. These bad actors pose as “consultants” or “claims experts,” using aggressive tactics to exploit Veterans. They promise:
- Expedited claims processing
- Guaranteed higher disability ratings
- Special access to VA systems
- Faster results than traditional channels
All of these promises are false. Remember: No one can guarantee a VA rating or speed up the standard process.
Common Types of VA Benefits Scams
The “Secret Program” Scheme
One of the most insidious new schemes involves scammers claiming they know about “hidden” VA programs. Here’s how it works:
- They contact Veterans claiming to know about secret government benefits
- They demand upfront fees to access these supposed programs
- They request personal information to “verify eligibility”
- Once they have your money or information, they disappear
Remember: All VA programs are public information. There are no “secret” benefits programs.
The Cash-for-Benefits Trap
This particularly cruel scam targets Veterans facing financial difficulties:
- Scammers offer immediate cash payments
- In exchange, they demand rights to future disability or pension payments
- The cash offered is far less than the benefits are worth
- This arrangement is illegal and can result in loss of benefits
Never sign over or sell your VA benefits rights. It’s illegal and always a bad deal.
Document and Records Scams
Be aware that scammers are charging Veterans for:
- Access to military service records
- Copies of VA forms
- Processing of government paperwork
- “Special” filing services
The truth: You can obtain all these documents FREE through the VA or National Archives.
Pension Poaching Schemes
These complex scams often target older Veterans:
- Financial “advisers” suggest moving assets to qualify for more benefits
- They sell expensive financial products or create trusts
- They rarely explain the serious risks involved
- These moves can disqualify Veterans from other benefits like Medicaid
- They often lock away Veterans’ money with strict access limits
Warning Signs of VA Benefits Scams
Red Flags to Watch For:
- Anyone charging fees for initial VA claims
- Requests for your VA account passwords
- Demands for banking information
- Pressure to act quickly or “lose out”
- Guarantees about claim outcomes
- Offers that seem “too good to be true”
Protective Steps Against Benefits Fraud:
- Never pay anyone to file an initial VA claim
- Don’t share VA account passwords
- Keep your banking information private
- Get everything in writing
- Consult with accredited representatives before making financial decisions
- Report suspicious activity immediately
